PLANS to redevelop the former Glenelg Cinema site are back before Holdfast Bay Council, bolstered by fresh legal opinion supporting the project.
The case by Wallis Cinemas is expected to be reconsidered tonight, April, 28, by the development assessment panel (DAP), which knocked back two separate proposals for a mixed restaurant/office project at the Jetty Rd site last December.
Both proposals for a one-storey and a two-storey development would require the demolition of the 73-year-old former Ozone Theatre building, which was closed on February 1, 2009.
Opinion from counsels Michael Roder and Stuart Henry has been included in the revised bids.
Wallis spokesman Philip Roberts said the approach aimed at avoiding a potentially costly Environment, Resources and Development (ERD) hearing.
“We’ve taken the unusual step of seeking opinion from two senior counsels regarding their interpretation of the law, which supports very strongly the Wallis position,” he said.
“Both of them independently came up with the same view that the Wallis Group was in the right.”
The original proposals were refused primarily for failing to provide associated on-site car parking, as required under the council’s development plan.
Holdfast Bay’s manager development services Anthony Marroncelli said if the applications were approved by the DAP this week, they would be signed off next month.
Mr Roberts said while the overall plans had not changed, Wallis would commit to making either a $150,000 or $300,000 contribution to the Glenelg parking strategy fund, depending on the development option.
“We do not believe there needs to be any contribution at all but as a sign of good faith we have put in a proposal where we would assist,” he said.

It will be a complete outrage if they demolish this art-deco building for some poxy 1-2 level building. There are plenty of other places in Glenelg where they could build lowrise offices.
I also can not believe that the Ozone building has not been heritage listed.

What, in heaven's name, is the "Glenelg parking strategy fund"? In a perfect world, it would be a shadowy subversive group who engage in random acts of intervention on parking spots in Glenelg, changing one into an outdoor tea-room, or a group into a croquet lawn. I suppose it's actually something like a pot of money to build a car-park.

It's annoying my big time just reading this. How can they prefer something that will certainly be less imposing and have less architectural merit.
