A $70 MILLION apartment building backed by media magnate Kerry Stokes is too tall for Adelaide and must not be built, the Federal Government says.
In an unusual move, Commonwealth solicitors have filed Environment, Resources and Development Court action against the proposed development.
The Federal Government wants the court to revoke Western Core Projects’ permission to build a 23-storey complex on Angas St, adjacent to the Commonwealth Law Courts.
That building houses the Federal, Family and High Courts — but, according to court documents, the government’s objection is based on neither privacy nor security concerns.
It says state regulations require developments in the area not exceed 22m in height, meaning the 83m complex cannot legally be built.
In November, The Advertiserrevealed the proposed project — a joint venture between international investor Plenary Group and Melbourne’s Flagship Property Holdings.
Flagship was established in 2008 by major shareholders including Mr Stokes’ Seven Group Holdings.
Seven Group and Mr Stokes’ private company, Australian Capital Equity, together hold a 50 per cent interest in Premier Capital Developments, which will manage the complex.
The complex is slated to be built adjacent to the Commonwealth courts, on land acquired by Western Core in a failed bid to develop the new SA Police headquarters.
Designed by Woods Bagot, the proposal includes 138 one, two and three bedroom apartments across 23 storeys.
In its appeal documents, the Federal Government seeks orders quashing approval given, by the Development Assessment Commission, to erect the structure.
It says the complex was “incorrectly” assessed as a legally-compliant category one development, and should have been deemed an incompliant category two project.
The government says the complex is to be erected in the “city living zone” and therefore must not exceed 22m in height as per the rules of that zone.
The court has yet to list a date for hearing of the government’s appeal.

When is this article from? It is like someone has made it up. The building is 30 stories, 103m and because the site is over 1500sqm it has no height limit. Not one bit of information is correct. I can't access the article but it makes me think it was prior to them acquiring the adjacent site if it is even legitimate.
Apparently the article was "written" by the Advertisers crime reported. What the hell! Maybe i should get my cat to submit an article on legalizing marijuana... makes the same sense.

I had a check of the height limits, and there's a boundary between sections which put the law courts in the zone with no prescribed height limits, and Kodo in the zone with a 57m height limit. Who the hell knows where they've pulled 22m from.

Truly bizarre but if it actually has happened then it's a good sign that they didn't refer to (potentially nebulous) privacy or security issues and purely to the height zoning... which as pointed out already is surely not applicable.
Edit: None of this article makes any sense! Why would the Commonwealth have any interest in this issue if it isn't related to the Courts building? What on earth is the interest in using Commonwealth resources to file what looks like a nuisance claim (and an ignorant one at that)?

Yeah great. Our Federal Government (for which we pay taxes) is fighting out State Government (for which we pay taxes) in court (for which we pay taxes) where the only winners are the lawyers (who also know how to not pay taxes). Mind boggling ripoff all round.
